Starting September 11, 2026, the "One-Step" procedure under the Hague Convention (Apostille Convention) officially went into operation in Vietnam. This regulation was enacted pursuant to Government Decree No. 293/2026/ND-CP dated July 23, 2026, providing guidance on the implementation of the Convention. The adoption of the Apostille simplifies administrative procedures, ensuring legal validity for individuals and organizations preparing documents for study abroad, settlement, employment, and international business. 3 quốc gia Châu Âu không áp dụng Công ước Apostille với Việt Nam

Căn cứ khoản 2 Điều 12 Công ước La Hay, Công ước sẽ không có hiệu lực áp dụng giữa Việt Nam và các quốc gia thành viên gửi tuyên bố phản đối. Theo thông báo chính thức, 03 quốc gia Châu Âu sau đây đã gửi tuyên bố phản đối sự gia nhập của Việt Nam:

1. Cộng hòa Liên bang Đức (Federal Republic of Germany)

2. Cộng hòa Áo (Republic of Austria)

3. Cộng hòa Séc (Czech Republic)

Lưu ý thủ tục bắt buộc: Mọi giấy tờ công sử dụng qua lại giữa Việt Nam và 3 quốc gia nêu trên KHÔNG được dán tem chứng nhận Apostille. Toàn bộ hồ sơ bắt buộc phải thực hiện thủ tục Chứng nhận lãnh sự và Hợp pháp hóa lãnh sự theo Nghị định số 111/2011/NĐ-CP (được sửa đổi, bổ sung bởi Nghị định số 196/2025/NĐ-CP), căn cứ theo quy định tại khoản 4 Điều 5 Nghị định số 293/2026/NĐ-CP.

3 European Member States Exempting Vietnam from Apostille

Pursuant to Clause 2, Article 12 of the Hague Convention, the Convention does not take effect between Vietnam and member states that submit an official declaration of objection. According to official notices, the 03 European nations below have formally submitted objections to Vietnam's accession:

1. Federal Republic of Germany

2. Republic of Austria

3. Czech Republic

Mandatory Procedural Note: All public documents used between Vietnam and these 3 countries CANNOT receive an Apostille certification stamp. Instead, all documentation must strictly undergo Consular Certification and Consular Legalization under Decree No. 111/2011/ND-CP (as amended and supplemented by Decree No. 196/2025/ND-CP), pursuant to Clause 4, Article 5 of Decree No. 293/2026/ND-CP.

• Vương quốc Thái Lan: Gia nhập Công ước vào ngày 30/06/2026, nhưng Công ước chỉ bắt đầu có hiệu lực từ ngày 28/02/2027. Trước mốc thời gian 28/02/2027, các loại giấy tờ giao dịch với Thái Lan vẫn áp dụng thủ tục hợp pháp hóa lãnh sự truyền thống.

• Lãnh thổ Greenland: Đan Mạch đã đưa ra tuyên bố chính thức về việc Công ước Apostille không áp dụng đối với lãnh thổ Greenland.

Special Territorial and Temporal Provisions

In addition to the 3 European countries mentioned above, clients must pay close attention to specific territorial and timeline limitations:

• Kingdom of Thailand: Acceded to the Convention on June 30, 2026, but the treaty enters into force only from February 28, 2027. Prior to February 28, 2027, documents transacted with Thailand still require traditional consular legalization.

• Territory of Greenland: Denmark issued an official declaration stating that the Apostille Convention does not apply to Greenland.
